Stone Memories is a trading name of JX Group & Co Pty Ltd (ABN 77 691 604 485), referred to as "Stone Memories", "we", "us" or "our". We operate this website and store (the Services), powered by Shopify.

By using the Services, you agree to these Terms of Service (Terms) and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and accounts

  • You confirm you are at least 18, or have the consent of a parent or guardian.
  • You agree to provide accurate information and keep your account details secure.
  • You are responsible for all activity on your account.

2. Our products

  • We make every effort to describe and photograph our products accurately, but colours and appearance can vary with device settings and natural stone variation.
  • Our travertine and limestone pieces are natural and hand-cut. Colour, veining, pitting, texture, shape and size vary, and sizes are approximate. Edges are left natural and unsanded and can be sharp. These variations are part of each piece's character and are not defects.
  • Descriptions, pricing and availability may change. Changes don't affect orders we have already accepted.
  • We may limit sales to any person, region or jurisdiction.

3. Orders

  • Your order is an offer to buy. It is accepted when we confirm it and process payment.
  • You can cancel for a full refund, or change your design, within 24 hours of placing your order. After that, production begins and we can't cancel or change it. See our Returns, Refunds & Issues Policy.
  • If we need to cancel an order (for example, we can't use the content supplied), we'll notify you using the contact details from checkout and refund you.
  • Purchases are for personal, household or gifting use. We welcome bulk and corporate orders by arrangement. Please email us. You must not resell our products without our written agreement.

4. Personalisation and your design content

  • You are responsible for making sure all personalisation details (photos, names, dates, spelling and messages) are correct when you order. We make your piece exactly as you've designed it.
  • The on-screen preview is a guide only. We don't send a separate proof. Your finished piece will vary naturally in texture, veining, shape and tone, and we'll make sure your design sits neatly on the stone and isn't cut off.
  • You confirm that you own, or have permission to use, all photos, images, text and other content you submit. Images should be high resolution.
  • We may decline any order containing content that is unlawful, offensive, infringes someone else's rights, or is copyrighted material you don't have the rights to use. If we decline, we'll contact you and refund your order.
  • You give us a non-exclusive licence to use your content only to produce your order. We don't use it for marketing without your permission (see section 14).
  • Custom line drawings are created from photos you supply and are charged as shown when you order, as is optional text on the back.
  • If your finished piece differs from the design you submitted because of our error, our Returns, Refunds & Issues Policy applies.

5. Prices and billing

  • Prices are in Australian dollars.
  • Shipping and any add-ons are charged as shown at checkout. See our Shipping Policy.
  • You agree to provide current and accurate billing details and authorise us to charge your payment method for all amounts due.

6. Shipping and delivery

  • Every piece is made to order. Allow up to 4 weeks for dispatch. Delivery timeframes are estimates only. See our Shipping Policy.
  • Risk in your order passes to you when it's delivered to the address you gave us. If it arrives damaged, see our Returns, Refunds & Issues Policy.

7. Safe use and care

Your stone is heavy and has natural, unsanded edges that may be sharp. Please:

  • Display it indoors, in a dry place, using the included stand on a flat, stable surface
  • Keep it away from edges and places it can be bumped, and out of reach of young children and pets
  • Lift it with two hands and handle with care
  • Use it for display only

Care instructions are on each product page. Nothing in this section limits your rights under the Australian Consumer Law (ACL).

8. Intellectual property

  • All content on our website and platforms, including text, images, graphics, product designs and trademarks, is owned by JX Group & Co Pty Ltd, trading as Stone Memories, or its licensors.
  • You may use our website and materials for personal, non-commercial purposes only.
  • No rights to our products, designs or materials are granted except as set out in these Terms.

9. Third-party tools and features

We may offer access to third-party tools (such as personalisation apps or payment gateways) that we don't control. These are provided "as is" and "as available," and your use is subject to that provider's terms.

10. Third-party links

Links to third-party websites are provided for convenience. We are not responsible for their content, accuracy or practices.

11. Relationship with Shopify

Stone Memories is powered by Shopify. Purchases are made directly with Stone Memories, and Shopify is not a party to your transactions. To the extent the law allows, you release Shopify and its affiliates from claims arising from your purchases with us.

12. Privacy

Personal information is handled under our Privacy Policy. Because we use Shopify and other online tools, some data may be processed outside Australia.

13. Feedback and reviews

If you submit ideas, reviews or other content ("Feedback"), you grant us a worldwide, royalty-free licence to use and display it in any medium. You confirm you own the rights in your Feedback and that it complies with the law. We may moderate or remove Feedback.

14. Photos of finished keepsakes

We may ask for your consent to photograph or share your finished keepsake (with or without names or dates). We only publish such images with your permission or in anonymised form.

15. Errors and omissions

We may correct errors in information, including pricing and availability. If a correction affects an order we've already accepted, we'll contact you and you may cancel for a full refund.

16. Prohibited uses

You must not misuse the website or our materials, including unlawful activity, infringing intellectual property, harassment, malware, spamming, scraping or circumventing security measures. We may suspend or end your access for breaches of these Terms.

17. Termination

We may suspend or end the Services, in whole or in part. Sections intended to survive termination continue to apply. Orders already accepted will be honoured or refunded.

18. Disclaimer

Except as required by law, our website is provided "as is" and "as available," and we don't warrant uninterrupted or error-free access. Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you have under the Australian Consumer Law (ACL).

19. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, including loss of profits, data or goodwill, arising from your use of our website. This does not limit any rights you have under the ACL.

20. Indemnity

You agree to indemnify Stone Memories, its officers, employees and agents against losses arising from content you submit infringing someone else's rights, or from your misuse of the Services, except where caused by our negligence or breach of law.

21. Severability

If any provision of these Terms is invalid or unenforceable, it will be read down or removed to the extent necessary, and the rest will continue to apply.

22. Waiver and entire agreement

A failure to enforce a right is not a waiver. These Terms and the policies referred to in them are the entire agreement between you and us.

23. Assignment

You may not assign your rights without our consent. We may assign or transfer our rights and obligations at any time.

24. Governing law

These Terms are governed by the laws of [Queensland / New South Wales], Australia, and you submit to the courts of that state.

25. Changes to these Terms

We may update these Terms by posting a revised version on our website. We'll notify you of material changes where the law requires. Changes apply to orders placed after the update. Your continued use of our website after an update constitutes acceptance.

26. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, pandemics, carrier delays, strikes, acts of government or service outages. We'll use reasonable efforts to minimise the impact.
