Stone Memories is a trading name of JX Group & Co Pty Ltd (ABN 77 691 604 485), referred to as “Stone Memories”, “we”, “us” or “our”.
We operate this website and store (the Services) powered by Shopify.

By using the Services, you agree to these Terms of Service (Terms) and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access & Accounts

You confirm you are at least the age of majority in your state or territory (18 in Australia), or you have the consent of a parent or guardian.
You agree to provide accurate information and to keep your account details secure.
You are responsible for all activity on your account.

2. Our Products

We make every effort to describe and photograph our products accurately, but colours and appearance can vary depending on device settings or natural stone variations.
Descriptions, pricing, and availability may change without notice.
We may limit sales to any person, region, or jurisdiction at our discretion.

Our travertine and limestone pieces naturally vary in colour, veining, texture, and edges. These variations are part of each piece’s character and are not considered defects.

3. Orders

Your order is an offer to buy; we may accept or decline it at our discretion.
An order is accepted when we confirm and process payment.
Please review your order carefully before submitting - personalised orders may not be cancellable once accepted.

If we change or cancel an order, we’ll notify you via the contact details provided at checkout.
Returns are handled under our Refunds & Returns Policy.
You confirm purchases are for personal or household use only and not for resale.

3A. Personalisation & Approvals

You are responsible for ensuring all personalisation details (e.g. names, dates, or messages) are correct at the time of order.
We may provide on-screen previews or proofs for some products; your approval constitutes acceptance of the design.
After approval or submission, changes may not be possible.

4. Prices & Billing

Prices are in AUD where applicable.
Unless stated otherwise, prices exclude shipping and any additional taxes or charges.
You agree to provide current and accurate billing details and authorise us to charge your payment method for all amounts due.

5. Shipping & Delivery

Creation times for made-to-order items are stated on product pages.
Delivery timeframes are estimates only.
Risk of loss passes to you when we hand over your order to the carrier.

6. Intellectual Property

All content on our website and digital platforms - including text, images, graphics, product designs, and trademarks - is owned by JX Group & Co Pty Ltd, trading as Stone Memories, or its licensors.
You may use our website and materials for personal, non-commercial purposes only.
No rights to our products, designs, or materials are granted except as expressly set out in these Terms.

7. Third-Party Tools & Features

We may offer access to third-party tools or features (such as personalisation apps or payment gateways) that we don’t control.
These are provided “as is” and “as available,” without warranties.
Your use of any third-party tool is at your own discretion and subject to that provider’s terms.

8. Third-Party Links

Links to third-party websites or content are provided for convenience only.
We are not responsible for their content, accuracy, or practices.
Please review their terms and policies before engaging with them.

9. Relationship with Shopify

Stone Memories is powered by Shopify. Purchases are made directly with Stone Memories; Shopify is not a party to your transactions.
You release Shopify and its affiliates from claims arising from your purchases with us.

10. Privacy

Personal information is handled in accordance with our Privacy Policy and Shopify’s privacy practices.
Because we use Shopify, some data may be processed outside Australia.

11. Feedback & Reviews

If you submit ideas, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use and display it in any medium.
You warrant you own the rights in your Feedback and that it complies with the law.
We may moderate or remove Feedback at our discretion.

11A. Photos of Finished Keepsakes 

We may request your consent to photograph or share your finished keepsake (with or without names or dates).
We will only publish such images with your permission or in anonymised form.

12. Errors & Omissions

We may correct errors or update information (including pricing and availability) at any time without prior notice, including after an order is submitted.

13. Prohibited Uses

You must not misuse the website or our materials - including unlawful activity, intellectual property infringement, harassment, malware, spamming, scraping, or circumventing security measures.
We may suspend or terminate access for breaches of these Terms.

14. Termination

We may suspend or terminate the Services (in whole or part) at any time.
Sections intended to survive termination will continue to apply.

15. Disclaimer of Warranties

Except as required by law, the Services and products are provided “as is” and “as available.”
We do not warrant uninterrupted or error-free access.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (ACL).
Where permitted, our liability is limited (at our option) to replacement, repair, resupply, or reimbursement of costs.

16. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential losses - including loss of profits, data, or goodwill - arising from your use of our website or products.
Our liability under non-excludable guarantees of the ACL is limited as described above.

17. Indemnity

You agree to indemnify and hold harmless Stone Memories, its officers, employees, and agents from losses arising from your breach of these Terms or misuse of the Services, except where caused by our negligence or breach of law.

18. Severability

If any provision of these Terms is invalid or unenforceable, it will be read down or severed to the extent necessary, and the remaining provisions will continue in effect.

19. Waiver & Entire Agreement

A failure to enforce a right is not a waiver.
These Terms and the policies referenced constitute the entire agreement between you and us.

20. Assignment

You may not assign your rights without our consent.
We may assign or transfer our rights and obligations at any time.

21. Governing Law

These Terms are governed by the laws of Australia, and you submit to the jurisdiction of the courts of the Commonwealth of Australia and the state or territory where Stone Memories is headquartered.

22. Changes to These Terms

We may update these Terms by posting a revised version on our website.
Material changes will be notified where required by law.
Your continued use of our website after updates constitutes acceptance.

23. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control - including natural disasters, pandemics, carrier delays, strikes, acts of government, or internet/service outages.
We will use reasonable efforts to minimise any impact.

24. Gift Cards

Stone Memories digital gift cards are non-refundable and cannot be exchanged for cash, either in full or in part.
They may be used only for purchases through our online store.
Gift cards have no expiry date and remain valid until the total balance is used.
Treat your gift card code as confidential; anyone with access to it may redeem it.
Once issued, gift card codes cannot be cancelled, replaced, or refunded.
